If you have been accused of a misdemeanor or a felony crime, whether under state or federal law, you are facing the loss of your freedom. No situation merits the need of experienced and effective criminal defense lawyer more than if you are facing this possibility.
Criminal defense begins as soon as the client contacts and hires the lawyer. The scene of the alleged crime must be visited as soon as possible and witnesses must be promptly interviewed. Failing to do this might result in evidence being changed, destroyed, or even lost. Bond hearings are also important because it is the lawyer's job to make sure that the accused is not incarcerated while the case is pending. Preliminary examinations should not automatically be waived and need to be held in certain situations. After reviewing the evidence and police report, the attorney must determine if the client's constitutional rights have been violated and file the appropriate motion to have the evidence excluded, if necessary.
If plea negotiations are discussed, then the client must decide if it is in his or her best interest to accept the deal. This is not the attorney's decision. Whether or not to proceed to trial and defend the criminal charge is the client's decision to make.
