Conservatorships

Conservatorships exist to help people who cannot manage their own financial affairs. Sometimes, they help children. Other times, they help disabled adults or frail elders.

There are times when an estate plan has had the forethought to create conservatorships. However, there are many occasions where state probate courts are notified by a family member or concerned citizen of such a need, and upon investigation, the court itself creates a conservatorship to manage the person's assets.

Conservators take on the responsibility of managing the financial affairs of the person who is unable to do so, or the ward. Conservators pay the ward's bills, file the ward's taxes, and insure that no one exploits the ward financially. All conservatorships are reviewed annually by the court. Sometimes, conservators also act as the ward's guardian, but this is not always the case.
